AHA, others file amicus brief supporting hospital in challenge to Lilly 340B policy
The AHA, the New Hampshire Hospital Association and 340B Health have filed an amicus brief supporting Mary Hitchcock Memorial Hospital’s request for a preliminary injunction against Eli Lilly’s new 340B claims data policy. Mary Hitchcock Memorial Hospital is part of Dartmouth Health.
The brief, which was filed in the U.S. District Court for the District of New Hampshire, contends that Lilly’s policy imposes significant administrative burdens on hospitals, threatens access to critical 340B discounts and ultimately could reduce resources available for patient care. It also argues that federal 340B law does not preempt laws that protect consumers and prohibit unfair trade practices. The organizations emphasize that preserving access to 340B savings is essential to helping hospitals sustain care and services for vulnerable and underserved communities.
